The Holiday Apartment
The holiday apartment contained within this website should be booked for holiday purposes, and should not be used for party purposes, weddings or filming only unless otherwise agreed in writing. We reserve the right to increase the Deposit on the holiday apartment should such a use be agreed in writing.
Arrival & Departure Times
All Rentals commence at 4.00pm on the first day of the rental and end at 10.00am on the day of departure unless otherwise notified and agreed in writing. This period is hereafter referred to as the 'Holiday'. If you anticipate the need to either arrive much earlier or later on the first day of the rental or depart much later on the departure day, please contact Olive Tree so that we can see whether or not we will be able to accommodate your needs.
Guests will be notified of the Holiday period in the confirmation that will be sent out on receipt of the booking.
Guest's Obligations
All guests should leave the holiday apartment in a clean and tidy condition and also to ensure the holiday apartment is left in the same condition, as it was when they first arrived. Olive Tree reserves the right to charge an excess cleaning fee where additional deep cleaning is required beyond what can normally be expected. This excess cleaning fee will be deducted from the guest's deposit payment.
Written consent is required from Olive Tree if a party wishes to include more guests in the holiday apartment than its stated occupancy level.
- Smoking is not permitted in the holiday apartment.
- No Pets.
- No children aged 6 and under.
Olive Tree reserve the right to terminate the visit of any party whose conduct is detrimental to the holiday apartment or to other guests.
The Booking Procedure
When a booking is made either via the website, the guest must pay a Deposit to provisionally secure the holiday apartment. The Deposit amount shall be 25% of the total holiday apartment rental and is payable on booking the holiday apartment either via the website.
The entire booking fee (the final payment) shall be due to Olive Tree no later than 6 weeks before the arrival date. If payment is not received prior to 6 weeks of the arrival date, non-payment will be treated as a cancellation, this will mean that the guest will lose their booking as well as their deposit.
If a booking is made within six weeks of the arrival date then the full rent plus any additional charges must be paid at the time of booking.
Cancellation
If the guest cancels a booking 12 weeks or more prior to the date of arrival, the deposit will be refunded in full less the standard administration charge (£50). If the cancellation falls within 12 weeks of the arrival date, the deposit will not be refundable unless Olive Tree are able to find an alternative guest for that period. If Olive Tree are able to find an alternative booking, then the deposit will be refunded in full less the standard administration charge (£50).
Olive Tree may be able to alter the date of a booking so as to avoid cancellation charges, where possible we will do our utmost best to accommodate guests. Please contact us to discuss this further.
Payment Types
We accept the following payment types:
- Visa and Mastercard; Maestro (formerly Switch); Solo and Visa Delta.
- Cheques are not accepted.
Liability
We warrant that we will carry out the service to you with a reasonable level of care and skill. If you require any changes to these terms, please request such changes in writing to the address above. Any liability under any agreement between you and us shall be limited to any sums paid by you to us. As far as permitted by law, we shall not be liable to any person for losses or damages that were not reasonably foreseeable and that were not caused by any breach on our part.
We shall not be liable to any person for any direct or indirect loss or damage as a result from your holiday booking. Any liability that does arise will be limited to the fee paid.
Events Outside Our Control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ('Force Majeure Event').
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
Law And Jurisdiction
Contracts for holiday bookings through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
